Peru Adjusts Online Gaming Law: Key Tax Changes and Fight Against Match-Fixing
The Congress of the Republic of Peru has finally (and happily) approved PROJECT OF LAW No. 9645, in order to make adjustments and modifications to the Peruvian regulatory framework for REMOTE GAMBLING AND REMOTE SPORTS BETTING, ruled by Law No. 31557 (year 2022), amended by Law No. 31806 (year 2023) and regulated by Supreme Decree No. 005-2023-MINCETUR.
This project of law seems intelligent and pertinent to me, because, in my opinion, it generates empathy with operators and investors, national and foreign, in the Peruvian gaming industry.
The most important change is that it is proposed that the CALCULATION BASE of the Selective Consumption Tax (ISC) is the GGR (or Net Win, or the difference between the bet amount and the prizes paid) and NOT only the total amount of the bet as it is currently.
I say that this proposed modification is «empathetic» for operators and investors because it seeks to equalize the tax burden or impact between national and foreign operators of sports betting platforms and/or remote gambling, eliminating (or at least drastically reducing) negative distortions that had been affecting the market.
In addition, there are other proposals for changes such as incorporating the crime of manipulation of sports results into the Penal Code.
