La nueva referida a la explotación de los juegos a distancia y apuestas deportivas a distancia fue promulgada ayer. Entraría en vigor en noviembre. Según el Mincetur, permitirá recaudar cerca de S/ 160 millones anuales.
Una noticia muy esperada en el sector
La norma fue aprobada por el Congreso de Perú el 25 de mayo pasado con 105 votos a favor. Aún restaba su promulgación, que ocurrió ayer.
El Ministro de Comercio Exterior y Turismo, Juan Carlos Mathews, resaltó los beneficios de la ley publicada en el Diario Oficial y las mejoras que establece frente a la ley anterior (Ley N° 31557).
Afirmó que hubo una completa concordancia con el Poder Legislativo en las correcciones realizadas para establecer un marco regulatorio adecuado.
“Permitirá recaudar cerca a los S/ 160 millones anuales a ser invertidos en la reactivación del turismo, además en obras de infraestructura pública, promover el deporte y atender programas de salud mental”, finalizó el ministro Mathews.
En qué consiste la nueva norma
Destacamos algunos de los aspectos clave de la norma:
EDAD DE LOS APOSTADORES: Solo las personas mayores de edad, tanto de nacionalidad peruana como extranjera, registradas en las plataformas tecnológicas de los juegos y apuestas deportivas en línea autorizadas por el Mincetur, podrán participar en esta actividad.
UBICACIÓN: En el caso de los locales para la operación de apuestas deportivas en línea, podrán ubicarse en establecimientos exclusivos para esta actividad o en otros que también realicen actividades adicionales, como la venta de productos o servicios.
DOMINIOS: Además, se establece que las empresas autorizadas por el Mincetur deben contar con una plataforma tecnológica que tenga las extensiones de dominio «.bet.pe», «.bet», «.com», «.pe» o «.com.pe», las cuales son otorgadas por entidades públicas o privadas encargadas de asignar dichos dominios.
MEDIOS DE PAGO: En cuanto a las apuestas, la nueva ley indica que los jugadores deben realizar el pago de sus apuestas con dinero en circulación, tarjetas de crédito, débito u otros medios de pago, excluyendo las criptomonedas.
PREMIOS: En caso de obtener premios, estos podrán ser cobrados a través del medio de pago elegido por el jugador o, en su defecto, mediante una cuenta a su nombre en una entidad del sistema financiero supervisada por la SBS.
EVENTOS: Es importante destacar que solo pueden ser objeto de apuesta aquellos eventos deportivos que sean parte de asociaciones, federaciones o ligas deportivas nacionales o internacionales.
PUBLICIDAD: Solo el titular de la autorización puede patrocinar o publicitar a empresas, personas naturales, eventos o actividades de cualquier índole, siempre y cuando dicho patrocinio no viole la legislación existente.
Frente al incumplimiento: multas, inhabilitaciones y hasta cuatro años de cárcel
El Ministerio de Comercio Exterior y Turismo (Mincetur) es la autoridad administrativa a nivel nacional encargada de regular, autorizar, revocar, supervisar y sancionar la operación de los juegos y apuestas deportivas en línea.
Es relevante resaltar que cualquier persona que organice, dirija o opere casinos, máquinas tragamonedas, juegos o apuestas deportivas en línea sin cumplir con los requisitos establecidos por las leyes y sus reglamentos, será sancionada con pena privativa de libertad no menor a un año ni mayor a cuatro años, además de una multa de 365 días y la inhabilitación para ejercer dicha actividad.

Key aspects of the new regulation

AGE OF BETTORS: Only individuals of legal age, both Peruvian nationals and foreigners, registered on Mincetur-authorized online gaming and sports betting platforms, will be allowed to participate in this activity.
LOCATION: In the case of venues for online sports betting operations, they can be located in establishments exclusively dedicated to this activity or in others that also engage in additional activities, such as selling products or services.
DOMAINS: Additionally, it is established that companies authorized by Mincetur must have a technological platform with domain extensions «.bet.pe», «.bet», «.com», «.pe», or «.com.pe», which are granted by public or private entities responsible for assigning such domains.
PAYMENT METHODS: Regarding bets, the new law states that players must make their payments with legal tender, credit cards, debit cards, or other payment methods, excluding cryptocurrencies.
PRIZES: In case of winning prizes, they can be collected through the payment method chosen by the player or, if not available, through an account in their name at a financial institution supervised by the SBS.
EVENTS: It is important to highlight that only sports events that are part of national or international sports associations, federations, or leagues can be subject to bets.
ADVERTISING: Only authorized entities can sponsor or advertise companies, individuals, events, or activities of any kind, as long as such sponsorship does not violate existing legislation.
Non-compliance: Fines, disqualifications, and up to four years in prison
The Ministry of Foreign Trade and Tourism (Mincetur) is the national administrative authority responsible for regulating, authorizing, revoking, supervising, and sanctioning the operation of online gaming and sports betting.
It is noteworthy that anyone who organizes, directs, or operates casinos, slot machines, or online gaming and sports betting without complying with the requirements established by laws and regulations will be punished with imprisonment for a term not less than one year and not exceeding four years, in addition to a fine of 365 days and disqualification to engage in such activity.
